  • ACTION: Notice of request for public comment: “Application for Permanent/Temporary Export or Temporary Import of Classified Defense Articles and Classified Technical Data” (DSP-85)

  • SUMMARY: The “Application for Permanent/Temporary Export or Temporary Import of Classified Defense Articles and Classified Technical Data” (Form DSP-85) is used to obtain permission for the permanent export, temporary export, or temporary import of classified defense articles, including classified technical data, covered by the U.S. Munitions List (USML). This form is an application that, when completed and approved by the Bureau of Political Military Affairs, Directorate of Defense Trade Controls (PM/DDTC), Department of State, constitutes the official record and authorization for all classified commercial defense trade transactions, pursuant to the Arms Export Control Act and the ITAR. The purpose of this notice is to allow 60 days for public comment preceding submission of the collection to OMB.

13. ECD: “3 Chip-Related Export Control Bills Gain Conservative Group's Backing”

Heritage Action, a conservative political advocacy group and sister organization of the Heritage Foundation, said last week it supports three export control bills aimed at curbing China’s access to American semiconductor technology and helping the U.S. win the "all-important AI race."

The bills are the “Chip Security Act”, which would require anti-diversion measures for export-controlled advanced chips to prevent smuggling to China; the “AI Overwatch Act”, which would restrict sales of advanced chips to China; and the “Match Act”, which seeks to harmonize U.S. and allied restrictions on sales of chipmaking tools to China.  . . .

14. Export Practitioner: “Arms Export Report: Long-Tail Nature of U.S. Defense Trade"

The State Department’s Directorate of Defense Trade Controls (DDTC) has released its FY 2025 Annual Report to Congress on Direct Commercial Sales authorizations, providing a detailed snapshot of licensed U.S. defense exports by country, weapons category and shipment activity. 

The report, issued pursuant to Section 655 of the Foreign Assistance Act and Section 38 of the Arms Export Control Act, covers defense articles and defense services licensed for permanent export during fiscal year 2025. It includes both aggregate authorization values and actual shipment data for exports executed during the reporting period.   . . .

The report also highlights how “AGREEMENT” categories — technical-assistance agreements and manufacturing-license agreements — increasingly dominate high-value defense-trade relationships, often exceeding the value of physical hardware exports. DDTC cautioned that licenses generally remain valid for four years while agreements can remain active for substantially longer periods.   . . .

The House Armed Services Committee’s draft fiscal 2027 defense policy bill would eliminate the Space Development Agency and the Space Rapid Capabilities Office as standalone organizations, aligning with the Pentagon’s plan to reorganize Space Force acquisition programs under Portfolio Acquisition Executives.  . . .

16. ECD: “Lawmaker Seeks to Curb China’s Purchases of US General Aviation Firms”

Rep. Pat Harrigan, R-N.C., urged Congress May 26 to pass legislation restricting China’s acquisition of U.S. general aviation companies.

China has made dozens of such purchases over the past two decades, including Cirrus Aircraft, which makes piston-powered planes, Harrigan wrote in a piece for the Washington Examiner. He said such transactions allow China to obtain American technology and expertise it can use for commercial and military purposes.

While deals involving commercial aviation receive “intense scrutiny,” the Committee on Foreign Investment in the U.S. and the Commerce Department “lack the teeth to police general aviation,” Harrigan said.

17. Volkov: “DOJ Indicts Chinese Shipping Container Cartel: A Wake-Up Call for Antitrust Compliance”

The case involves conduct at the heart of America’s COVID-era supply chain crisis. And for compliance professionals worldwide, it is one of the most important antitrust enforcement wake-up calls in years.  . . .    

This case is a textbook illustration of what happens when antitrust compliance is absent or ignored at the leadership level. The conspiracy was not concealed from senior management. It was driven by senior management. CEOs, chairmen, and vice presidents of the world’s largest container companies were the architects of the scheme. That reality makes this case both an enforcement story and a governance failure of the first order.  . . .

All defendants face one count of conspiracy in restraint of trade under Section 1 of the Sherman Antitrust Act. For individuals, the statute carries a maximum of 10 years in prison and $1 million in fines — though fines may be doubled based on actual gains derived from the crime. For corporations, the maximum fine is $100 million, subject to the same doubling provision. Given the profit figures alleged, actual exposure could far exceed the statutory baselines. . . . 

For U.S. businesses engaged in international trade—particularly in regions like the Middle East where restrictive trade practices are more prevalent—the Quantum enforcement action emphasizes the need to implement comprehensive compliance protocols that address the complexities of antiboycott regulations. It is essential that companies develop internal controls and reporting procedures capable of identifying and escalating boycott-related requests for timely reporting to BIS. Without such mechanisms, companies may face the risk of inadvertent violations and substantial penalties.

To mitigate these risks, U.S. companies must focus on training employees—particularly those involved in international sales, procurement, and compliance functions—to recognize boycott-related requests and to escalate them through appropriate channels. Comprehensive training programs should be supplemented by well-defined reporting protocols that ensure all boycott-related requests are properly documented and reported in accordance with U.S. law. Furthermore, regular compliance audits should be conducted to review international transactions for any boycott-related issues and to ensure that the company’s reporting obligations are being met in a timely and accurate manner. Finally, U.S. companies should consider incorporating antiboycott compliance clauses into their international contracts. These clauses should make clear that the company will not engage in or support any foreign boycott that is not sanctioned by the U.S. government. By proactively addressing the issue in a contractual context, companies can reduce the likelihood of receiving boycott-related requests and better insulate themselves from potential legal exposure. 1788: Publication of The Federalist. On this day, the Federalist papers—a series of 77 essays defending the proposed new U.S. Constitution and discussing the nature of republican government, written in 1787–88 by Alexander Hamilton, James Madison, and John Jay—were published in book form as The Federalist. They were written to persuade Americans to ratify the Constitution. Today, they are considered one of the most important works explaining the structure of the U.S. government, separation of powers, checks and balances, and the meaning and intent of the Constitution.
