EXCERPTS: "Effective with respect to goods entered for consumption, or withdrawn from warehouse for consumption, on or after 12:01 a.m. eastern daylight time on June 8, 2026, subchapter III of chapter 99 of the HTSUS is modified as provided in Annex IV to this proclamation and the lists of products provided in Annex I-A, Annex I-B, Annex II, and Annex III of Proclamation 11021 are modified as set forth in the annexes to this proclamation. . . ."

On June 3, 2026, the White House issued an Executive Order ("Strengthening Customs Enforcement") that directs the U.S. Department of Homeland Security ("DHS") and U.S. Customs and Border Protection ("CBP") to take a series of actions intended to combat customs fraud, transshipment, forced labor imports, duty evasion, and other trade-related violations. While many of the directives will require future rulemaking or policy changes before becoming effective, the Order signals a significant increase in customs enforcement and scrutiny of foreign importers.

14. ECD: "UN Security Council Renews Sudan Sanctions"

The U.N. Security Council voted 9-0 on May 29, with six abstentions, to renew its Sudan sanctions for one year, until May 31, 2027. The countries voting in favor of the renewal were the U.S., Bahrain, Colombia, Denmark, France, Greece, Latvia, Panama, and the U.K., while China, the Congo, Liberia, Pakistan, Russia and Somalia abstained. The council said some members expressed concern that sanctions are "hindering progress towards lasting peace."
15: TechStory: "California Tech CEO Arrested for Decade-Long Smuggling of American Equipment to Iran's Nuclear and Military Programs"

Federal authorities in the United States arrested a California-based technology executive on June 3, 2026, on charges that he spent more than a decade running a covert supply chain that funnelled restricted American networking and encryption hardware to some of Iran's most sensitive state institutions including the agencies overseeing its nuclear programme and its military. The arrest, announced by the US Department of Justice, represents one of the most significant sanctions enforcement actions against an Iran-linked procurement network in recent years.
Jamshid Ghomi, 63, a Newport Coast resident and CEO of Tehran-based Faraz Pardaz Rayaneh Co. Ltd. (FPR), was arrested on a federal criminal complaint accusing him of conspiracy to violate the International Emergency Economic Powers Act (IEEPA). Ghomi is a dual citizen of the United States and Iran, which afforded him access to American suppliers and financial systems that a purely foreign national would not have had. . . .

What's the Use? One problem Trade Compliance Professionals ™ have with engineers[1] is the latter can't figure out why everything isn't EAR99. OK, maybe that death ray or nuclear submarine might require a license, but "we just build widgets, so what's the big deal?" The big deal is that in addition to the fact that Specially Designed Isn't Fair ©, the ITAR Isn't Fair© either. At the intersection Catch-alls.
We start our hypothetical with a supplier which is a fine purveyor of electrical transformers, a technology dating back to the late 1800's. While these are relatively simple, they are often very specific for an application. Say a French customer asks the supplier for a transformer built to their specs, just like every other customer. While transformers are found in electronics literally everywhere, this one is Specially Designed for this application (i.e., no paragraph (b) release.)
An "ordinary" transformer is EAR99. The supplier asks the customer for an End Use Statement (EUS) and it comes back that the transformer will be used in equipment for the Indian navy. Military is no big deal as "electrical transformers" are listed right there in ECCN 3A611.y.13, which is controlled only for AT and RS. As I like to say – Hold it right there, Bucko!
The ITAR is packed with dozens of Catch-alls, and "For the Indian navy" won't cut it. For example, the transformer ends up in a XII(c)(6)(vii) infrared imaging system – XII(e)(8) is the Parts and Components Catch-all for that entry, and poof! - transformer is ITAR-controlled. 3A611.y13 does you no good because the Order of Review won't let you get there. But XII(c)(6)(vii) has very specific performance requirements; if the Indian system's Ground Sampling Distance is greater than 0.5 meters, it isn't controlled by XII(c)(6)(vii) and XII(e)(8) doesn't apply, and the transformer likely falls off the ITAR and safely into 3A611. Then again, the French customer may be using your transformer in a public address system for the Indian navy's new commissary. Back to EAR99. Same. Damn. Transformer[2].

17. ECD: "EU Ambassador Wants Fewer US Export Control 'Surprises'"

The U.S. can't act alone on technology export controls and expect its restrictions to be successful, said Jovita Neliupsiene, the EU's ambassador to the U.S. She also said the EU is hoping for fewer export control "surprises" from the U.S., specifically mentioning the Biden-era AI diffusion rule and the Trump administration's decision to approve advanced Nvidia chip exports to China.
Speaking during an event hosted this week by the Atlantic Council, Neliupsiene said one of the ways that the U.S. and EU can build better trust is to work together on new export control decisions. She said she understands that "not everybody in this country and in this administration value very much international cooperation," but controls won't be effective without that collaboration. . . .

It has been a busy week for the Trump administration on the trade front (and it is only Thursday). In this time, the administration has made a dizzying number of important announcements:
Proposed an additional tariff on imports from 60 countries (which account for 99.4% of U.S. imports): . . .
Proposed an additional tariff of 25% tariff on imports from Brazil: . .
New Section 301 investigation on Vietnam's policies and practices regarding the protection of IP rights which could result in additional tariffs be imposed on imports: . . .
Announced that the United States and China have established a Board of Trade to "ensure that trade with China is more balanced and beneficial for Americans" and solicited public comments on the types of "non-sensitive products" that could be subject to "favorable tariff modification by both sides": . . .
Further modified the Section 232 tariffs on steel, aluminum and copper products: . . .
Issued an Executive Order on strengthening customs enforcement.
So, what are they doing here? On the one hand, they are seeking to replace the tariffs imposed under IEEPA, which were struck down by the Supreme Court back in February. They are not just replacing the tariffs (in the 20% range is where we think they will end up). They are also replacing the flexibility that IEEPA provided the president -- since IEEPA had no limitations on the duration or rate of tariffs to be imposed in the administration's view. . . .
Companies need to be following these developments closely so as not to get caught off guard, as things are moving much more quickly than they did in the past (e.g., Section 301 investigations historically took 12 months or so; the forced labor investigation mentioned above was done in 82 days). . . . 19. Space News: "NRO Nominee Says Commercial Space and AI are Reshaping Spy Satellite Agency"

Roger Mason, President Trump's nominee to lead the National Reconnaissance Office, told senators that the nation's spy satellite agency is navigating a period of rapid innovation in commercial space and artificial intelligence that is transforming space-based intelligence.
Appearing June 2 before the Senate Intelligence Committee for his confirmation hearing, Mason described the National Reconnaissance Office, or NRO, as being in the midst of a transformation driven by commercial innovation, growing volumes of intelligence data and increasing threats to U.S. assets in space.
"We are in a space renaissance where the pace of technology advancement, speed of innovation and promise of the future has drawn unprecedented investments," Mason said.
Mason, currently chief growth officer at V2X Corp., would succeed Christopher Scolese, who has led the NRO since 2019. The NRO operates the nation's spy satellites and acquires commercial satellite imagery used by military commanders and civilian policymakers. . . .
Mason said maintaining strong ties with private industry would be essential as the agency expands its satellite architecture and seeks access to emerging technologies. . .

1989: Culmination of Chinese protest at Tiananmen Square. In May 1989, nearly a million Chinese, mostly young students, crowded into central Beijing to protest for greater democracy and call for the resignations of Chinese Communist Party leaders deemed too repressive. For nearly three weeks, the protesters kept up daily vigils, and marched and chanted. On June 4, Chinese soldiers responded, killing and arresting thousands of pro-democracy protesters.
