ACTION: General notice.
SUMMARY: This document notifies the public that U.S. Customs and Border Protection (CBP) is taking initial steps to implement Executive Order 14411 "Strengthening Customs Enforcement." CBP is executing enhanced enforcement procedures to verify the accuracy of the information provided by new and existing importers of record on the CBP Form 5106, consistent with Executive Order 14411 and governing statutes. Importers of Record (IORs), or customs brokers providing information on the IOR's behalf, must provide accurate and complete information for the IOR. Inaccurate information may result in immediate voiding of IOR numbers and other enforcement actions. IORs, or customs brokers providing information on the IOR's behalf, should ensure that the information is accurate to avoid the voiding of their IOR number, and in preparation for future Executive Order implementation.
DATE: This enhanced enforcement, including immediate voiding of IOR numbers with inaccurate information on the CBP Form 5106, will commence on September 18, 2026.

The Department of the Treasury's Office of Foreign Assets Control (OFAC) is issuing International Criminal Court-related General License 12, "Authorizing the Wind Down of Transactions Involving Certain Persons Blocked on August 18, 2026."

GARCIA, Circuit Judge: "Federal law requires the Secretary of Defense to annually publish a Section 1260H list identifying all "Chinese military companies" operating in the United States.
Inclusion on the Section 1260H list carries concrete legal consequences. The Secretary of Defense may not "enter into, renew, or extend a contract for the procurement of goods, services, or technology" with a listed company or an entity controlled by one.
In 2024, the Secretary included Hesai Technology Co., Ltd., and its subsidiary, Hesai, Inc. (collectively, Hesai) on that list. Hesai sued, claiming the Secretary violated the Fifth Amendment's Due Process Clause and the Administrative Procedure Act.
The district court granted summary judgment to the Secretary. We reverse based on Hesai's due process claim. Because the Secretary's designation carries reputational and legal consequences, it implicates a protected interest.
The Constitution therefore required the Secretary to provide Hesai notice of the unclassified materials on which he intended to rely, and a meaningful opportunity to respond before finalizing the designation. The Secretary provided neither, and that error was not harmless.
We therefore reverse and remand so that the Secretary may afford Hesai the process it is due."

"According to senior executive branch officials, Canada has expressed a commitment to remove the discriminations or unreasonable and unequal impositions at issue in Proclamations 11046, 11047, and 11048. In these officials' opinion, because of the status of these negotiations, the public interests favor suspending for a period of 3 days the additional duties imposed in Proclamations 11046, 11047, and 11048. . . .
I determine that in these circumstances, the public interest requires suspending for a period of 3 days the additional ad valorem duties imposed in Proclamation 11046, 11047, and 11048."

11. Expeditors News: "BIS Issues Final Rule Restricting Tungsten and Black Mass Exports"

In a temporary final rule published in the Federal Register on August 6, 2026, the Bureau of Industry and Security (BIS) announced that it was restricting the exportation of black mass and tungsten waste and scrap without a license.
BIS defines black mass as "shredded lithium-ion battery scrap that contains cathode material (which may include lithium, cobalt, nickel and manganese), anode material (graphite, silicon) or other residual battery cell materials."
Under this rule, U.S. person who engage in the sale of black mass and tungsten waste and scrap must "allocate 100 percent of monthly sales to U.S. persons, unless an adjustment or exception is obtained in advance from BIS."
BIS is accepting public comments through the Federal rulemaking portal at https://www.regulations.gov by November 4, 2026, on this temporary final rule.
This temporary final rule will be effective from August 27, 2026, through August 27, 2027.

12. FedEx News: "South Korea — Mandatory Registration of Cross-Border e-Commerce Business Identification Number"

Korea Customs Service (KCS) has introduced a registration system for cross-border e commerce business identification numbers to enhance the management of cross-border e commerce shipments and facilitate efficient customs clearance.
Accordingly, businesses handling cross-border e-commerce shipments in South Korea are required to register for a cross-border e-commerce business identification number through the dedicated registration system.
Eligible businesses:
Overseas businesses operating an online marketplace and offering shipping services to South Korea.
Domestic businesses operating an online marketplace or selling through an online marketplace that provide cross-border e-commerce purchasing agency or sales intermediary services.
Domestic and overseas businesses providing international forwarding services for cross-border e-commerce shipments destined for South Korea. (Businesses previously registered with KCS as purchasing agents or e-commerce businesses must also re-register through the new registration system.)

13. Shapiro: "CBP Announces Enhanced Enforcement of Importer of Record Verification Requirements"

U.S. Customs and Border Protection (CBP) announced in the today's Federal Register enhanced enforcement procedures to verify the accuracy of information provided by new and existing Importers of Record (IORs) on CBP Form 5106.
Beginning September 18, 2026, CBP may immediately void an IOR number if information on the Form 5106 is inaccurate. Additional enforcement actions may also apply. . . .
These enhanced procedures are part of CBP's initial implementation of Executive Order 14411, "Strengthening Customs Enforcement."
How This Affects You: We strongly encourage all importers to review their current CBP Form 5106 information as soon as possible. This means:
Review the 5106 (for each entity, if you operate through multiple entities) from your ACE portal importer page, and verify that every required field is correct.
Confirm the physical address is the importer of record's actual location—not a service provider's location or a PO Box.
Confirm the phone number and email address are valid, current, and monitored— and actually belong to the importer of record, not a service provider.
Make certain to implement internal controls to limit who can modify Form 5106 data.
If any information is outdated or inaccurate, it should be corrected promptly (and before September 18, 2026) by submitting a new 5106 to help avoid the potential voiding of your IOR number and resulting disruptions to your U.S. imports.

On July 23, 2026, the US Department of State designated multiple entities and individuals in Cuba, and the US Department of the Treasury's Office of Foreign Assets Control ("OFAC") issued three new Cuba-related general licenses.
The actions are intended to further restrict revenue streams supporting the Cuban government, including activities tied to the energy sector, sanctions evasion networks, financial services, and Cuba's overseas medical missions program.
The designations and general licenses were issued under Executive Order 14404 of May 1, 2026, which authorizes sanctions targeting persons linked to repression in Cuba and other activities deemed to threaten US national security and foreign policy.

OFAC Issues New Cuba-Related General Licenses: In conjunction with the designations, OFAC issued three new Cuba-related general licenses:
Cuba General License 2: authorizing transactions that are ordinarily incident and necessary to the wind down of any transaction involving CEIBA or any entity in which CEIBA owns, directly or indirectly, a 50 percent or greater interest until August 22, 2026.
Cuba General License 3: authorizing, until August 22, 2026, transactions that are ordinarily incident and necessary to: . . .
Cuba General License 4: authorizing certain transactions that are ordinarily incident and necessary to the conduct of the official business of third-country diplomatic or consular missions located in Cuba.
These actions represent the continued expansion of the US government's Cuba sanctions strategy under Executive Order 14404 and indicate a focus on Cuba's energy and financial services sectors, alleged sanctions evasion activity, and third-country actors facilitating revenue generation for the Cuban government.

On August 13, 2026, the White House published a Proclamation imposing duties under Section 232 of the Trade Expansion Act of 1962 ("Section 232") on imports of unmanned aircraft systems (UAS) and their parts and components.
Following the Commerce Department's recommendation, the President unveiled a staggered system of tariffs to address the national security threat posed by U.S. reliance on foreign-sourced UAS, strengthen America's UAS industry and supply chain, and bolster the domestic defense industrial base.
The President further authorized the Secretary of Commerce to establish an onshoring incentive program for companies making new investments in manufacturing UAS and UAS components in the U.S. This action builds substantially on previous actions by the Federal Communications Commission (FCC) and Department of War (DoW) regulating the use of foreign-produced UAS and UAS components in the United States (summarized here).
The Proclamation assigns tariff rates on UAS and UAS components between 10% and 100% depending on various factors including drone weight, country of origin of substantially all hardware and software, and status under parallel FCC/DoW actions. These tariffs enter into effect on September 3, 2026. . . .
Significantly, however, the action defers tariffs for existing determinations made by the interagency regarding certain foreign-made UAS products. Specifically, no tariffs will apply until at least 180 days after signing (February 9, 2027), for products that have been placed on either the Blue UAS Framework or the BLUE UAS Cleared List, or have been granted a Conditional Approval by DoW or the Department of Homeland Security (DHS) to exempt them from the FCC's Covered List (collectively, "Approval Lists").
Tariffs will also be deferred for any products that are added to one of the Approval Lists before September 2, 2026. . . .

U.S. Customs and Border Protection ("CBP") issued a Federal Register notice that it is now ready to execute "executing enhanced enforcement procedures."
CBP has indicated that it will start verifying importer of record information provided by each importer on CBP Form 5106, and importers of record have until September 18, 2026, to correct any errors to avoid penalties or other consequences.
CBP has stated that if there is any incorrect or inaccurate information on these forms that it may result in the voiding of importer of record numbers, and penalties and other legal liability for importers of record and their brokers.
To provide context, the increased enforcement is viewed as necessary given that the importer of record data is the key identifier that is linked to the liability for payment of duties.
CBP is viewing the provision of inaccurate information on the Form 5106 and Form 7501 as material to the assessment of duties and in certain instances penalties.
The information that CBP will very also includes the importer's physical address, which must be the actual address and not a P.O. box, the importer's email address and the importer's phone number. All information must belong to the importer, not their broker or other related party. . . .
If CBP determines that any of the information is inaccurate, CBP will immediately void the associated importer of record number and issue a written Notice of Action to the importer of record to notify them. . . .
Under the new enforcement protocols, customs brokers may also be subject to broker penalties or other consequences if they transmit information to CBP that they know is false or misleading. Customs brokers must also have a valid power of attorney with the importer of record that authorizes the broker to submit information to CBP for the importer.

President Trump has issued a proclamation delaying from Aug. 19 to Aug. 22 the imposition of an additional 50 percent tariff on about $20 billion worth of imports from Canada under Section 338 of the Tariff Act of 1930.
Background. Section 338 empowers the president to impose tariffs on imports of a foreign country to offset the burden or disadvantage from its discrimination against or unequal imposition on U.S. commerce.
A White House fact sheet lists several Canadian policies that it said meet that description, including
tariffs and quotas on cars imported from the U.S. but not from other countries,
the administration of those quotas in a way that compels U.S. auto companies to invest in production in Canada instead of the U.S.,
the cessation by all but two Canadian provinces and territories of the purchase, distribution, or retailing of U.S. alcoholic beverages without similar restrictions on other countries, and
tariff-rate quotas on U.S. cheese that are more restrictive than TRQs imposed on similar imports from the EU. . . .
