2. CBP Seeks Comments on the Proposed Extension of Free Trade Agreements

* SUMMARY: The U.S. negotiates and implements free trade agreements (FTAs) and preferential trade legislations (PTLs), also known as preference programs, to promote prosperity for the U.S. economy. FTAs and PTLs open new markets for U.S. exports, protect American producers and workers, and encourage free and equitable trade among our trading partners.
     Free Trade Agreements (FTAs) are established to reduce and eliminate trade barriers, strengthen, and develop economic relations, and lay the foundation for further cooperation to expand and enhance benefits of the agreement between partner countries.
     These agreements establish free trade by reduced-duty treatment of imported goods. FTAs encourage international trade by making it easier and cheaper for businesses to export and import products and services between partner countries.

CSMS # 69402038 - An Updated Appendix PGA is Now Available in the DRAFT Chapters of CBP.gov. CSMS # 69428352 - Modifications to the Processing of Post Summary Corrections.
     GUIDANCE: Electronic Payment Requirement. The filer must electronically remit payment for increases in duties, taxes, and fees resulting from a PSC via Automated Clearinghouse (ACH). Effective August 5, 2026, filers will no longer be able to pay these increases via check or cash. This is a modification from 82 FRN 2385, dated January 14, 2017, which stated the PSC test only allowed for these payments to be deposited at the port of entry listed on the entry summary.
     The filer submits the PSC electronic payment authorization to U.S. Customs and Border Protection (CBP) through the Automated Broker Interface (ABI). The filer should visit Automated Clearinghouse on CBP.gov or contact [email protected] to participate in either the ACH Debit or ACH Credit payment programs with CBP, or to obtain the specific information needed to submit a PSC payment to CBP.
     To pay by ACH Credit, participants should contact [email protected] to obtain specific instructions needed to pay a supplemental duty bill via ACH Credit. For technical questions about submitting a PSC, the Trade should contact their assigned CBP Client Representative. . . .

7. Justice Dept Publishes Trade Fraud Enforcement Resource Guide

     We are pleased to announce the publication of A Resource Guide to Trade Fraud Enforcement. This Guide is intended to provide information for businesses, individuals, and their attorneys as well as the public regarding customs, trade, and related fraud.
     The Guide has been prepared by the Trade Fraud Task Force, a partnership of the U.S. Department of Justice (DOJ) and U.S. Department of Homeland Security (DHS), including the National Fraud Enforcement Division, Criminal Division, Civil Division, Environment and Natural Resources Division, the U.S. Attorney's Office for the Northern District of Illinois, U.S. Immigration and Customs Enforcement's Homeland Security Investigations (HSI), and U.S. Customs and Border Protection (CBP).

9. Treasury/OFAC Issues Amended Venezuela-related General License and FAQs

     The Department of the Treasury's Office of Foreign Assets Control (OFAC) is issuing Venezuela-related General License 5Y, "Authorizing Certain Transactions Related to the Petróleos de Venezuela, S.A. 2020 8.5 Percent Bond on or After September 17, 2026."
     Additionally, OFAC is issuing one amended Venezuela-related Frequently Asked Question, FAQ 595.

10. UK Export Control Notice to exporters 2026/18: F680 applicants to use LITE instead of SPIRE

     From the 31st July 2026 SPIRE will no longer be processing F680 applications where permission to release material graded at OFFICIAL-SENSITIVE or above is being sought.
     Please use the Apply to Export Controlled Goods Service, also known as LITE.
     F680 applications for the release of unclassified ITAR only material in a stand-alone application will continue to be assessed on SPIRE.
     F680 applications relating to the release of material with a security grading of OFFICAL-SENSITIVE or above which are submitted on SPIRE after the 31st July 2026 will not be actioned and will be returned to the applicant with a request to reapply through on LITE.
     Applications which contain a mixture of OFFICIAL-SENSITIVE material and related ITAR elements must be made on LITE regardless of whether those elements are classified or unclassified.
     The change only applies to F680 forms. It does not apply to stand alone unclassified ITAR which must still be submitted on SPIRE until further notice.
     If you already use our new online service to apply for F680s for activities graded at OFFICIAL-SENSITIVE or above, you should continue to log into the service as normal. If you have never used the service, you need to register.
     Our intention is to transition all F680 applications off SPIRE in the future, including unclassified ITAR F680 forms. We will inform you of any updates via our Notices to Exporters.

12. Breaking Defense: "SpaceX Wins $1.6B to Launch Space Force 'Sensing and Targeting' Sats"

     WASHINGTON — The Space Force has tapped SpaceX for two more launch orders, worth $1.6 billion, under its newly-expanded National Security Space Launch (NSSL) Phase 3 Lane 1 program, Space Systems Command (SSC) announced today.
     NSSL Phase 3 Lane 1 is the Space Force's program for procuring commercial-style launches to: take payloads to easier-to-reach orbits; loft payloads with less mass; and/or support missions that are not absolute must-goes. Under the Lane 1 indefinite delivery/indefinite quantity contract vehicle, pre-qualified vendors compete for task orders for individual launches.
     The SpaceX task order is the first to be awarded since the service's July 17 announcement of a massive $11.4 billion plus-up to the contract's ceiling ― bringing the total amount to $17 billion ― to cover an increase in planned Lane 1 launches from 60 to 170 between 2025 and 2034. . . . 13. Expeditors News: "CBP Deploys Entry Type 13 Test and Resources"

     In two Cargo Systems Messaging Service (CSMS) bulletins issued in July; U.S. Customs and Border Protection (CBP) announced the deployment of the Entry Type 13 (ET13) test in the Automated Commercial Environment (ACE).
     The ET13 test was deployed on July 24, 2026, in ACE as a new entry type for electronically submitting U.S. Postal Service (USPS) international mail shipment data. ET 13 will officially deploy in production in ACE on September 22, 2026.
     CBP also provided updated implementation guides to support ET13 testing and eventual deployment, including draft updates to several CBP and Customs Trade Automated Interface Requirements (CATAIR) documents.

15. Tekedia: "China Tightens Exit Controls, Can Bar Citizens from Leaving Over Technology Security Risks"

     China has unveiled sweeping new exit-and-entry regulations that will allow authorities to prevent citizens from leaving the country if they are deemed a potential threat to national technology security.
     The new rules underline Beijing's aggressive efforts to safeguard strategic technologies, intellectual property and high-value talent amid intensifying geopolitical competition.
     The regulations, published Friday by the State Council, broaden the government's authority to impose travel restrictions on Chinese citizens and foreign nationals in cases involving national security, export controls and technology-related violations.
     The new rules will take effect on September 15, adding another layer to China's expanding legal framework aimed at protecting sensitive industries, particularly artificial intelligence, semiconductors, quantum computing and other technologies that Beijing considers critical to national development.
     Under the regulations, Chinese citizens may be prohibited from leaving the country if they are found to have violated export control laws or technology import and export regulations in ways that could endanger China's industrial or technological security.
     The measures significantly expand the circumstances under which authorities can restrict international travel, reflecting Beijing's growing emphasis on preventing the transfer of sensitive technologies, proprietary research and strategic know-how overseas.

16. Baker/McKenzie: "OFAC Restructures Hong Kong Sanctions Following Expiration of Executive Order 13936"

     On July 17, 2026, the US Department of the Treasury's Office of Foreign Assets Control ("OFAC") announced certain updates and changes to its Hong Kong-related sanctions program following the expiration of the national emergency declared in Executive Order ("EO") 13936, The President's Executive Order on Hong Kong Normalization. Key changes include:
     OFAC has removed parties designated under EO 13936 from its Specially Designated Nationals and Blocked Persons ("SDN") List. Assets blocked prior to July 14, 2026 remain blocked notwithstanding the expiration of the national emergency.
     Parties who were removed from the SDN List but remain sanctioned under the Hong Kong Autonomy Act ("HKAA") have been added to OFAC's Non-SDN Menu-Based Sanctions ("NS-MBS") List. We have discussed the HKAA previously in our blog post here.
     What Changed? OFAC explained that the expiration of EO 13936 does not affect the continuing validity of either the HKAA or the Hong Kong Human Rights and Democracy Act of 2019, another statute that authorizes the president to impose sanctions on Hong Kong. As a result, OFAC has taken a bifurcated approach: . . .
     In light of these changes, many persons previously designated as SDNs continue to face sanctions-related restrictions, but now under a different sanctions framework. Several prominent current and former Hong Kong and mainland Chinese officials were transferred to the NS-MBS List pursuant to the HKAA.

18. Sidley Austin: "FLETF Makes Major Expansion to UFLPA Entity List"

     On Friday afternoon, the Department of Homeland Security announced that the Forced Labor Enforcement Taskforce (FLETF) is adding 43 entities to the Uyghur Forced Labor Prevention Act (UFLPA) entity list.
     This is the first action by FLETF during the second Trump administration (and may be an effort to show the world that the United States is serious about forced labor enforcement after it imposed tariffs on imports from 60 jurisdictions last week purportedly because those jurisdictions have not adopted U.S.-style forced labor laws and/or have not enforced them to U.S. standards).
     Effective, Monday, August 3, 2026, U.S. Customs and Border Protection will apply a rebuttable presumption that articles produced by these entities were produced with forced labor and are, therefore, prohibited from entry into the United States. The listed entities are from a variety of industries, including pharmaceuticals, aluminum, gold, copper, lithium, textiles, food products, and others.
     Many of these companies appear to produce raw/intermediate materials that could be in a company's extended supply chain (i.e., given what they produce, these companies may not be a direct supplier, but could be a supplier to a supplier, etc.).
     All companies should review the list of companies (including the entity-specific information FLETF provided) to confirm whether any of these entities are in their supply chain. There has been a significant increase in customs-related enforcement, including forced labor-related enforcement, in recent months. . . .

19. ST&R Trade Report: "Forced Labor Import Ban List Expanded"

     Effective Aug. 3, goods produced by 43 companies based in China are prohibited from entering the U.S. after those entities were added to the Uyghur Forced Labor Prevention Act Entity List. The Department of Homeland Security said this is the largest single expansion of that list to date, a 30 percent increase in the number of entities listed, and the first in more than 18 months.
     Information from federal agencies said the entities being added include companies in the aluminum, cotton, apparel, copper, gold, seafood, frozen food, and transportation infrastructure industries, among others. They are being added for sourcing materials from China's Xinjiang Uyghur Autonomous Region or working with the XUAR government to recruit, transport, transfer, harbor, or receive Uyghurs, Kazakhs, Kyrgyz, or members of other persecuted groups out of the XUAR.
     The UFLPA Entity List is a consolidated register of the four lists required to be developed and maintained under that law: . . .
     The UFLPA establishes a rebuttable presumption that goods made wholly or in part in the XUAR are made with forced labor and are therefore excluded from entry into the U.S. CBP applies this presumption to goods mined, produced, or manufactured by entities on the UFLPA Entity List, which are thus prohibited from importation into the U.S. under 19 USC 1307. There are now 187 companies on this list, and DHS states that since enactment of the UFLPA it has denied entry to more than 24,300 shipments valued at nearly $1 billion. . . . [Full article]
