ACTION: Final rule.
SUMMARY: The Bureau of Industry and Security (BIS) is easing export controls on certain Unmanned Aerial Vehicles (UAVs or drones) and related parts, components, accessories, attachments, technology, and software under the Export Administration Regulations (EAR). Specifically, this rule Amends EAR parts 740, 744, and 774 of the Export Administration Regulations (15 CFR parts 730-774) to:
- eliminate wind gust tolerance as a parameter for determining UAV controls under the EAR;
- increase the threshold for national security controls on certain UAVs from an endurance of 30 minutes to an endurance of 3 hours;
- makes conforming changes to remove national security controls on software and technology associated with UAVs with an endurance less than 3 hours;
- maintain military end-use and end-user controls on those lower endurance drones and associated software and technology;
- clarify Commerce Control List (CCL) controls for certain UAVs specially designed for military use; and
- remove national security controls on certain specially designed parts, components, accessories, and attachments for such UAVs as they do not provide any significant military or intelligence capabilities.
DATE: This rule is effective on August 13, 2026.

2. President Continues National Emergency with Respect to Export Control Regulations

TEXT: On August 17, 2001, the President issued Executive Order 13222 pursuant to the International Emergency Economic Powers Act (50 U.S.C. 1701 et seq.). In that order, the President declared a national emergency with respect to the unusual and extraordinary threat to the national security, foreign policy, and economy of the United States related to the expiration of the Export Administration Act of 1979, as amended (50 U.S.C. 4601 et seq.). Because the implementation of certain sanctions authorities, including sections 11A, 11B, and 11C of such Export Administration Act of 1979, consistent with section 1766(b) of Public Law 115-232, the Export Control Reform Act of 2018 (50 U.S.C. 4801 note), is to be carried out under the International Emergency Economic Powers Act, the national emergency declared on August 17, 2001, must continue in effect beyond August 17, 2026. Therefore, in accordance with section 202(d) of the National Emergencies Act (50 U.S.C. 1622(d)), I am continuing for 1 year the national emergency declared in Executive Order 13222, as amended by Executive Order 13637 of March 8, 2013.

9. DSCA Updates Policies on Processing Requests for M-833 and Comparable Depleted Uranium Rounds and the Lebanese Armed Forces Assistance Program

DSCA has posted Policy Memo 26-104 Updated Guidance for Processing Requests for M-833 and Comparable Depleted Uranium Rounds. This policy memorandum lends transparency to U.S. Government processes by providing guidance related to processing requests for M-833 and comparable depleted uranium rounds under security cooperation.
This memo codifies the guidance in Chapter 3 of the Security Assistance Management Manual (SAMM). This memo:

Adds Section C3.7.9. Release for M-833 and Comparable Depleted Uranium Rounds.
Adds Section C3.7.9.1. Presidential Determination Requests.

13. AOAV: "BAE Systems to Pay $36m After 104 Breaches of US Arms Export Rules"

     The US Department of State announced on 13 August that it had reached an administrative settlement with America's arm of the UK's largest defence company, BAE Systems, over breaches of the Arms Export Control Act and the International Traffic in Arms Regulations, known as ITAR.
     The violations included unauthorised exports of technical data and defence services, as well as failures to comply with existing export authorisations.
     Among the cases identified was the transfer in December 2023 of technical data relating to printed wiring boards for Global Positioning System equipment to a manufacturer in China. According to the State Department, BAE later recognised that members of its supply-chain team had not fully understood the relevant export-control requirements and that its secure file-transfer systems had not adequately flagged the restrictions.
     Other breaches included sending military GPS-related technical data to Canada after a licence agreement had expired, transmitting technical information concerning a US Navy guided-missile destroyer to Germany, and sending specifications relating to an explosive mixture to the UK.
     BAE voluntarily disclosed all but one of the alleged violations. Of the $36 million penalty, the State Department suspended $18 million on condition that the money is used to strengthen BAE's compliance programme. . . .
     Such export-control failures go to the heart of whether governments can effectively oversee where military technology travels, who receives it, and whether the regulatory safeguards intended to control the global arms trade are functioning as they should. . . . [Full article]

In a Federal Register Notice (FRN) published on August 6, 2026, the Bureau of Industry and Security (BIS) requested public comments on a proposed addition of 14 steel, aluminum, and copper derivative articles to the list of products subject to Section 232 duties.
BIS proposes to include the following products in the scope of Section 232:

Aluminum powder
Brass-wind musical instruments, and their parts and accessories
Parts of welding machines and apparatus
Floor safes
Certain electric conductor cables
Fire extinguishers
Parts of heat exchange units
Parts of certain hydraulic engines and motors

     The Trump administration flagged dozens of US trading partners Thursday as potential risks in aiding Chinese tariff evasion, vowing to tap artificial intelligence to help detect illegal practices in the future.

     The White House report takes aim at its longstanding concern surrounding "illegal transshipment," where goods could be sent through a third country that faces lower US tariffs to avoid paying higher levies imposed by President Donald Trump.

17. Wall Street Journal: "BAE Systems Fined $36 Million for Illegal Exports"

BAE Systems is set to pay $36 million for violating U.S. export restrictions on military technology.

What are the charges? A U.S. subsidiary of the U.K.-based defense manufacturer was charged with violating U.S. arms trafficking regulations 104 times between 2019 and 2025, according to the settlement. The newly charged violations included a December 2023 episode in which the subsidiary sent technical data for a wiring board used in a GPS device to a manufacturer in China, according to the settlement. The subsidiary was charged with 38 violations related to the transfer.
Staffing issues: BAE's supply chain team didn't fully understand what constituted violations of export controls and its file transfer software failed to issue warnings before the designs were sent, State said, adding the company's staff weren't properly trained to address the situation.
Compliance monitor needed: BAE will also pay for an external compliance officer to audit its export controls program for at least 24 months, according to terms of an administrative settlement the U.S. State Department announced Thursday. State will suspend $18 million of the fine if BAE spends that money improving its compliance program, according to the settlement.
BAE's response: A spokesperson for BAE said the settlement only applies to the U.S. subsidiary, adding the company has been working to improve its compliance program over the last several years.

18. Baker/McKenzie: "White House Signals Heightened Transshipment Enforcement, Including AI-Enabled Targeting"

     On August 13, 2026, the Trump Administration released a report announcing its focus on illegal transshipment, where goods allegedly enter the United States through intermediary jurisdictions to reduce or avoid otherwise applicable duties, as a customs enforcement priority. The announcement arrives amid a sustained enforcement focus from the Administration on tariff evasion.
     Our prior blog posts on the U.S. Department of Justice to actively investigate tariff evasion-related misconduct, and an Executive Order directing agencies to tighten and escalate customs enforcement, are available here and here, respectively.
     The Administration has characterized the issue as large-scale tariff evasion and estimates that potential illegal transshipment and related tariff losses may reach tens of billions of dollars annually.
     The White House report identifies more than 40 countries as presenting elevated illegal transshipment risk, including major trading partners and smaller jurisdictions with free zones, bonded warehousing, port access, lower labor costs, or limited customs capacity.
     While the report acknowledges that not every shift in sourcing reflects illegal conduct, enforcement must differentiate between legitimate supply chain shifts and unlawful pass-through activity. That distinction will be especially important for supply chains relying on China-plus-one sourcing strategies, multi-country production, or USMCA and other preferential-origin claims. . . . 19. Bloomberg: "Trump Trade Enforcers Deploy AI in Tariff Evasion Crackdown"

     The Trump administration is developing an AI-powered "detective border" to crack down on trading partners suspected of enabling China to skirt tariffs on U.S. imports.
     In a report released Aug. 13, the White House Office of Trade and Manufacturing Policy accused dozens of countries of being part of China's "shadow transshipment network," sorting them "according to the scale of China-linked trade, the depth of their economic integration with China, and the weak-link advantages that make them susceptible to rerouting activity." . . .
     AI supply chain firm Exiger provided a midrange estimate of $75 billion in illegally transshipped goods between February 2025 and February 2026, which corresponds a loss of tariff revenue between $19 billion and $34 billion.
     More than 40 countries are associated with elevated illegal transshipment risk, the report from White House trade adviser Peter Navarro's office said, and "China's biggest enablers range from Mexico and Canada on U.S. land borders to the European Union, India, Japan and South Korea." . . . 20. Export Practitioner: "Bessent Says New Measures Against Iran Coming Next Week"

     Treasury Secretary Scott Bessent said the Trump administration will announce new economic measures against Iran next week, signaling a further escalation of Washington's campaign to isolate Tehran financially. . . .
     He said the United States would apply measures unprecedented in the history of the economic isolation of a country.
     Bessent did not identify the prospective targets or say whether the measures would include new sanctions, expanded enforcement of existing restrictions or additional pressure on countries and companies doing business with Iran. . . .
     The announcement would extend a pressure campaign that has targeted Iran's oil exports, shipping operations, financial intermediaries and sanctions-evasion networks. In July, the Treasury Department sanctioned more than 50 people, companies and vessels associated with a shipping network it said generated revenue for the Iranian government.
